Svitzer v Z Energy and Seafuels.
Judge Gendall in the Admiralty Court gave judgement on 20 July 2012. But there was no summary. So here’s mine.
The salvage company Svitzer sued Z Energy and Seafuels for price gouging and duress re Svitzer hiring the bunker ship Awanuia to them to pump oil off the Rena.
Seafuels owns Awanuia and was leasing it to Z Energy. Z agreed to make it available to Svitzer.
In court, despite Svitzer’s arguments, Z persuaded the judge that it didn’t have a case to answer. So Svitzer had to pay their costs.
But the judge thinks Seafuels might have a case to answer. So now the case goes to the next stage.
